Property rights preserved as Illegal use of eminent Domain is essentially defeated in South Bend.

After a 5 year battle with  the developers and the City of South Bend , My neighbors and I won, as the Developing entities bought our homes for a fair price (more than 3 times what the City was trying to force us to take) after the city didnt win the Summary Judgement hearing.

This was a clear case of a municipality overstepping its use of Eminent Domain powers, violating our property rights as homeowners.

This will cause other municipalities to adhere to the new rights our state legislature gave us in 2006 limiting the use of eminent domain.

Our victory was a victory for every homeowner in the State of Indiana!!
